What is and is not allowed on the Milk Supply Co marketplace

1. Purpose

Milk Supply Co is a peer-to-peer marketplace exclusively for human breast milk. This Prohibited Items & Compliance Policy ("Policy") outlines what may and may not be listed, sold, or purchased on the Platform, as well as prohibited practices and our compliance position regarding applicable laws and regulations.

2. Prohibited Items

The following items may not be listed or sold on the Platform:

  • Any product other than human breast milk. This includes infant formula, cow's milk, goat's milk, plant-based milks, or any other substance.
  • Adulterated breast milk. Breast milk that has been diluted with water, mixed with formula, combined with milk from another person, or altered with any additive.
  • Misrepresented products. Formula, animal milk, or any other substance falsely labeled or represented as human breast milk.
  • Expired or improperly stored milk. Breast milk that has been stored beyond recognized safe storage guidelines or has been stored under unsafe temperature conditions.
  • Breast milk from an undisclosed third party. Sellers may only list milk they have personally expressed. Reselling milk obtained from another individual is prohibited.
  • Controlled substances. Any illegal drug, controlled substance, or pharmaceutical product.
  • Non-food items. Medical devices, supplements, nursing equipment, or any product that is not human breast milk.

3. Prohibited Seller Practices

Sellers may not engage in the following practices:

  • Creating misleading listings with inaccurate descriptions of quantity, date expressed, storage conditions, or pricing.
  • Making false or unsubstantiated health claims about breast milk (e.g., claiming it cures diseases or has specific medical benefits beyond general nutrition).
  • Concealing health conditions, medications, or lifestyle factors that could affect milk safety.
  • Soliciting buyers for transactions outside the Platform to avoid fees or payment protections.
  • Manipulating reviews or ratings through fake accounts, incentivized reviews, or review trading.
  • Creating duplicate or spam listings to gain unfair marketplace visibility.
  • Misrepresenting identity or submitting fraudulent verification documents.
  • Price gouging during emergencies or periods of heightened demand (e.g., formula shortages).

4. Prohibited Buyer Practices

Buyers may not engage in the following practices:

  • Filing fraudulent disputes or providing false evidence to obtain unwarranted refunds.
  • Purchasing breast milk for resale or commercial purposes without explicit authorization.
  • Purchasing breast milk for any unlawful purpose.
  • Soliciting sellers for transactions outside the Platform.
  • Harassing or threatening sellers to obtain discounts or concessions.
  • Creating multiple accounts to circumvent Platform restrictions or exploit promotions.

5. Compliance Disclaimer

Legal Status of Peer-to-Peer Breast Milk Sales

The sale of human breast milk between individuals is legal in the United States. Breast milk is classified as a food product and is not a controlled substance. Peer-to-peer breast milk sharing and sales are not currently regulated by the U.S. Food and Drug Administration (FDA).

However, the FDA has issued guidance advising consumers about potential risks associated with feeding infants breast milk from unscreened donors, including exposure to infectious diseases and substances that may be present in the donor's milk.

Milk Supply Co operates as a marketplace facilitator, not a milk bank or healthcare provider. We do not produce, collect, screen, test, pasteurize, or certify any breast milk sold on the Platform. Users are responsible for conducting their own due diligence and assuming the risks associated with peer-to-peer transactions.

6. Regulatory Notice

Users should be aware of the following regulatory considerations:

  • FDA position: The FDA recommends against feeding infants breast milk from sources other than the infant's own mother unless the milk has been obtained from a source that has screened donors and processed the milk to reduce potential risks.
  • State laws: While the sale of breast milk is generally legal across the United States, some states may have specific regulations. Users are responsible for understanding and complying with the laws in their jurisdiction.
  • Shipping regulations: Breast milk is classified as a perishable biological material. Sellers must comply with all applicable shipping carrier guidelines when sending breast milk.
  • Tax obligations: Income earned from selling breast milk may be subject to federal and state taxes. Sellers are responsible for reporting income and paying applicable taxes.

7. Reporting Violations

If you encounter a listing, user, or activity that you believe violates this Policy, please report it immediately:

  • Report a listing: Use the report button on any listing page to flag prohibited items or misleading content.
  • Report a user: Use the report button on any user profile to flag suspicious accounts or prohibited behavior.
  • Email: Contact us directly at info@milksupplyco.com with the subject line "Policy Violation Report."

All reports are reviewed by our team. We take every report seriously and will investigate promptly.

8. Enforcement Actions

Violations of this Policy may result in one or more of the following actions, depending on the severity and nature of the violation:

  • Warning: A written notice informing you of the violation and the expected corrective action.
  • Listing removal: Immediate removal of any listing that violates this Policy.
  • Account suspension: Temporary suspension of your account, restricting your ability to list, buy, or sell on the Platform.
  • Account termination: Permanent removal from the Platform. Terminated users may not create new accounts.
  • Payout withholding: Pending payouts may be held to cover potential refunds or liabilities resulting from the violation.
  • Law enforcement referral: In cases of fraud, identity theft, or other criminal activity, we may report the violation to appropriate law enforcement authorities.
